BIA rules that under the REAL ID Act of 2005, an applicant for asylum must prove that race, religion, nationality, membership in a particular social group, or political opinion was or will be at least one central reason for the claimed persecution.  Matter of J-B-N- & S-M-, 24 I&N Dec. 208 (BIA, June 25, 2007).

Appeals Courts

7th Circuit

Asylum Case involving Female Genital Mutilation (FGM) in Cameroon remanded by 7th Circuit.  Court found that substantial evidence did not supoprt IJ and BIA findings.  Agbor v. Gonzales Case #06-2015 7th Cir. May 25, 2007.

• Seventh Circuit remands case to BIA directing them to review denial of asylum to Chinese couple regarding family planning initiatives in the Peoples' Republic of China.  Xiu Ling Chen v. Gonzalez Case #06-3980 7th Cir., June 11, 2007.

8th Circuit

Eighth Circuit vacates the BIA's decision affirming the IJ's order to reopen the proceedings and terminate the grant of asylum, stating that the DHS evidence submitted with the motion to reopen was not previously unavailable or undiscoverable with the exercise of due diligence.  Ivanov v. Gonzales,  Case No. 06-1178 8th Cir., Feb. 12, 2007.
